Notice of Public Hearings May 13

Notice is hereby given that a Public Hearing has been scheduled for Monday, May 13, 2019 at 5:00PM at the Fernie Senior Centre, located at 562 – 3rd Avenue, Fernie BC so that Council may hear representations from persons who believe their interest in property is affected by proposed amendments to Official Community Plan Bylaw No. 2231 and Zoning Bylaw No. 1750.

BYLAWS: Official Community Plan Bylaw No. 2231, Amendment Bylaw No. 11, Bylaw No. 2376, 2019; and Zoning Bylaw No. 1750 Amendment Bylaw No. 211, Bylaw No. 2377, 2019.

LOCATION: A 5404.2 m2 portion of 1301 – 4th Avenue (the subject area)
 
LEGAL DESCRIPTION: A 5404.2 square metre portion of Lot 2, District Lot 4588, Kootenay District, Plan 5009 

PURPOSE: The purpose of the Bylaw is to amend the Official Community Plan and Zoning Bylaws to:

Bylaw No. 2376 (OCP Amendment):

• Change the Land-Use designation of the subject area as set out in Schedule ‘B’ from: Institutional → to: Residential Mixed Use;

• Include the subject area as a Multi-Family Development Permit Area as set out in Schedule ‘Q’.

Bylaw No. 2377 (Zoning Amendment): 

Add Section 4.2.25 – CD5 - Comprehensive Development Five Zone to Zoning Bylaw No. 1750, written specifically for the development and including, for example:

• multi-family dwellings as a permitted use;

• maximum building heights ranging from 8 metres to 14 metres;

• requirements for off-street vehicle and bicycle parking; and

  • minimum setbacks from property boundaries.

• Changing the zoning designation of the subject area from P1: Public Institutional Zone → to: CD5 - Comprehensive Development Five Zone.

If approved the application would allow for the development of a proposed affordable rental housing project. 
 
The proposal is a “mixed-income, mixed-housing type, affordable housing project that aims to combine housing for families, singles, seniors and people with disabilities.” In total, this project would add 49 rental units, including: • 35 apartments (1, 2 and 3 bedroom units) • 14 townhomes (2 and 3 bedroom units)
 
The project would also include 5 designated accessible units, common indoor amenity area, outdoor landscaped area, 62 parking stalls and bicycle and scooter storage.

The deadline for written submissions is NOON on Monday, May 13, 2019.  No representation may be received by Council after the conclusion of the Public Hearing.  All submissions must include your name and civic address.
