Licences of Occupation – Patio Licence Program

Notice is given that the Council of the City of Fernie (the “City”) intends to grant licences of occupation in accordance with s. 26 and s. 35 of the Community Charter to the businesses listed below.

The proposed dispositions are in respect of portions of dedicated roadway, including sidewalks and/or roadways, adjacent to the listed civic addresses in the downtown area of Fernie, British Columbia. 

The licences of occupation will authorize the use of these areas for seasonal curb-side outdoor patios between May 1 and October 15 of each year, for a term of three (3) years commencing May 1, 2026, and expiring October 15, 2028, unless terminated earlier in accordance with their terms. The licences are non-exclusive and do not confer an interest in land.

In accordance with the City’s Expansion of Local Business onto Municipal Land and Highways Policy, the consideration to be received by the City for each licence of occupation includes a $50 application fee and an annual use fee of $10 per square metre, or $12 per seat where applicable, and may include other fees or deposits as required under the applicable licence of occupation agreement.
