Public Notice: Development Variance Permit No. 520

Pursuant to Section 499 of the Local Government Act, public notice is hereby given that Council for the City of Fernie will consider the issuance of Development Variance Permit No. DVP-520 at a Regular Meeting of Council on MONDAY, MARCH 28, 2022, at 7:00 PM in Council Chambers at FERNIE CITY HALL located at 501 – 3rd Avenue, Fernie, BC.

Regular Council meetings are available for all members of the public to attend electronically via a Zoom webinar link posted to the City of Fernie website prior to each meeting. Council Meetings can also be viewed via a Facebook live stream from the City of Fernie Facebook page.  

Location: 822 – 10th Avenue 

Legal Description: Parcel A (See XB18644), Block 77, District Lot 4588, Kootenay District, Plan 734A

Purpose: The proposed variance will allow the applicant to build a detached garage with a Secondary Dwelling Unit above on the subject lot by varying Zoning Bylaw No. 1750 as follows:

  1. Vary Section Rear-Yard setback From: 6.0 metres To: 2.5 metres
  2. Vary Section Side-Yard sideyard From: 3.7 metres To: 1.5 metres
  3. Vary Section 3.7.4c: Open Porch Projection into Rear-Yard Setback From: 1.8 metres To: 2.2 metres
  4. Vary Section 3.7.4c: Open Porch Projection into Side-Yard Setback From: 1.8 metres To: 2.2 metres
  5. Vary Section 3.7.4d:  Sundeck projection into Side-Yard Setback From 1.3 metres To: 2.3 metres
