Public Notice - Development Variance Permit No. 499

Pursuant to Section 499 of the Local Government Act, public notice is hereby given that Council for the City of Fernie will consider the issuance of Development Variance Permit No. DVP-499 at a Regular Meeting of Council on MONDAY, AUGUST 9, 2021, at 7:00 PM in Council Chambers at FERNIE CITY HALL located at 501 – 3 rd Avenue, Fernie, BC.
To comply with physical distancing requirements, Council meetings are held by electronic means as authorized by Ministerial Order No. M192. In-person meeting attendance is unavailable at this time and the public is encouraged to view meetings via the livestream webinar or archived recordings.

LEGAL DESCRIPTION: Lot 10, Block 23, District Lot 4588, Kootenay District, Plan 734, Except That Part of Lot 10 Lying West Of A Line Bisecting The Northerly Boundary Which Is The Boundary Between Lots 9 and 10 And the Southerly Boundary Which Is The Boundary On Jaffray Street Of The Said Lot
PURPOSE:The purpose of Development Variance Permit No. DVP-499 is to allow the applicant to rebuild an attached garage, renovate the second-storey, and add an attached sundeck onto the single-family dwelling located on the Subject Lot by varying Zoning Bylaw No. 1750 as follows: i. Section 3.7.4(d): Balconies and Sundecks projection into the required setback from 1.3 metres into the rear-yard setback To: 2.4 metres into the rear-yard setback ii. Section 126.96.36.199: Front-Yard Setback (Principal Building) From 7.5 metres To: 2.33 metres iii. Section 188.8.131.52: Rear-Yard Setback (Principal Building) From 6.0 metres To: 5.41 metres
