Public Notice - Development Variance Permit No. 483

Pursuant to Section 499 of the Local Government Act, public notice is hereby given that Council for the City of Fernie will consider the issuance of Development Variance Permit No. DVP-483 at a Regular Meeting of Council on MONDAY, MAY 10, 2021 at 7:00 PM in Council Chambers at FERNIE CITY HALL located at 501 – 3 rd Avenue, Fernie, BC.
To comply with physical distancing requirements, Council meetings are held by electronic means only as authorized by Ministerial Order No. M192. In-person meeting attendance is unavailable at this time and the public is encouraged to view meetings via the livestream webinar or archived recordings.
LOCATION: 1531 – 2 nd Avenue
LEGAL DESCRIPTION: Lot A, District Lot 4588, Kootenay District, Plan NEP90283 PURPOSE: The proposed variance will legalize the siting of an existing structure on the subject lot, decrease the minimum residential unit size and decrease the minimum parcel size and parcel frontage needed to allow a detached secondary suite on the subject property to remain as-is by varying the City of Fernie Zoning Bylaw No. 1750 as follows: • Section 22.214.171.124.1.1: Minimum Parcel Area required for a single family detached dwelling with a secondary dwelling unit From 600 sq. m. To 532 sq. m. • Section 126.96.36.199.1.2: Minimum Parcel Frontage required for a single family detached dwelling with a secondary dwelling unit From 18.3m To 14.18m. • Section 188.8.131.52.1.3(a): Minimum Rear-Yard Setback, Secondary Dwelling Unit From 6.0m To 1.70m: • Section 184.108.40.206.1.9: Minimum Residential Unit Size, Secondary Residential Unit From 56 sq. m. To 49.42 sq. m.
