Notice of Public Hearing - Bylaw No. 2445

Notice is hereby given that a public hearing has been scheduled for MONDAY, November 22, 2021 at 7:00 PM at FERNIE CITY HALL located at 501 – 3rd Avenue, Fernie, BC so that Council may hear representations from persons who believe their interest in property is affected by a proposed amendment to Zoning Bylaw No. 1750.  

To comply with physical distancing requirements, Council meetings are held by electronic means as authorized by Ministerial Order No. M192.  In-person meeting attendance is unavailable for the public at this time and the public is encouraged to view meetings via the livestream webinar or archived recordings. 

Location: CS1 – Service Commercial Zoned Properties and 1501 – 10th Avenue

Legal Description: Lot 1, Block 128, District Lot 4588, Kootenay District, Plan 902

Bylaw: Bylaw 2445, cited as Zoning Bylaw No. 1750 Amendment Bylaw No. 250, Bylaw No. 2445, 2021

Purpose: The applicant wishes to text amend the CS1 – Service Commercial Zone to allow offices as a permitted use above the street level storey of a building. This will legalize their current use of offices above the service commercial bays at the applicant’s building located at 1501 – 10th Avenue but will also allow for offices above the street level storey of buildings throughout the CS1 zone. Further, the applicant wishes to formalize the use of “kombucha brewery”, which was previously permitted through a Temporary Use Permit.
