Notice of Waived Public Hearing

NOTICE IS HEREBY GIVEN THAT the City of Fernie pursuant to Section 464 (2) of the Local Government Act has waived the holding of a Public Hearing in relation to proposed Bylaw 2404, an amendment to Zoning Bylaw 1750.  Bylaw 2404 is consistent with the City of Fernie Official Community Plan Bylaw 2231.  The Local Government Act allows for the waiving of public hearings in relation to zoning bylaws that are consistent with a municipality’s Official Community Plan. 

Council will consider third reading of Bylaw 2404 at the electronic Regular Council meeting scheduled for MONDAY, JULY 13, 2020 at 7:00 PM. Due to the COVID-19 public health emergency and under power of Ministerial Order No. M192, Council meetings are currently closed to the public and will be livestreamed on the City of Fernie Facebook page.

LOCATION: 1092 - 10th Avenue

LEGAL DESCRIPTION: Lot 6, Block 87, District Lot 4588, Kootenay District, Plan 902

BYLAW: Zoning Bylaw No. 1750 Amendment Bylaw No. 227, Bylaw No. 2404, 2020

PURPOSE: The applicant wishes to rezone their property (1092 – 10th Avenue: the “subject lot”) from R1 – Single Family Residential to R1SL – Single Family Residential Small Lot. This would allow the applicant to subdivide the property into two lots.
